6. User-Generated and AI-Generated Content

AI Forward’s AI tools generate content based on proprietary models and algorithms that remain our exclusive property. You may use AI-generated content for your internal business purposes, subject to these Terms, but you may not claim ownership of our AI models or training data.

Original modifications or derivative works you create based on AI-generated content are your property, provided they do not infringe upon our intellectual property rights or those of third parties.

7. Service Availability and Modifications

We strive to ensure continuous availability of our Products and Services, but we do not guarantee uninterrupted access. The Products and Services may be temporarily unavailable due to maintenance, updates, or technical issues. We reserve the right to modify or discontinue any feature or functionality with reasonable notice.

8. Payment Terms and Subscription Management

By purchasing our Products and Services, you agree to pay all applicable fees and taxes. We accept payments via:

• Credit card (processed securely through Stripe)
• Electronic funds transfer (e-transfer)

For subscription services:

• Recurring billing will occur according to your selected plan
• You may cancel your subscription at any time through your account settings or by contacting customer support

9. Limitation of Liability

To the maximum extent permitted by law, AI Forward disclaims all warranties regarding the Products and Services. We shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of the Products and Services, even if advised of the possibility of such damages.

Our total liability for any claim arising from these Terms shall not exceed the amount paid by you for the Products and Services during the twelve (12) months preceding the claim.

10. Confidentiality and Data Protection

11. Indemnification

You agree to indemnify, defend, and hold harmless AI Forward, its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses arising from your violation of these Terms or use of the Products and Services.

12. Dispute Resolution

In the event of any dispute arising under these Terms, you and AI Forward agree to first attempt resolution through good faith negotiations. If the dispute cannot be resolved amicably within thirty (30) days, it shall be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario. Both parties waive any right to a jury trial.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.

15. Changes to These Terms

We may update these Terms periodically. For material changes, we will provide notice via email or website announcement. Your continued use of our Products and Services after such notice constitutes acceptance of the updated Terms.
